1. Agreement to Terms

These Terms of Service ("Terms") constitute a legally binding agreement between you and PerkStation Ltd ("PerkStation", "we", "our", "us") governing your access to and use of our employee benefits platform.

By accessing or using PerkStation, you agree to be bound by these Terms. If you do not agree to these Terms, you must not access or use our platform.

2. Eligibility

To use PerkStation, you must:

  • Be at least 18 years of age
  • Be an employee of a company that has a valid subscription with PerkStation, or an authorised administrator for such a company
  • Have the authority to enter into these Terms
  • Not be prohibited from using our services under applicable law

3. Account Registration

To access our platform, you must register for an account using your work email address. You agree to:

  • Provide accurate and complete information during registration
  • Maintain the security of your account credentials
  • Notify us immediately of any unauthorised access to your account
  • Accept responsibility for all activities that occur under your account

We reserve the right to suspend or terminate your account if you breach these Terms or if your employment with your registered company ends.

4. Use of the Platform

4.1 Permitted Use

You may use PerkStation solely for your personal, non-commercial use to access employee discounts and perks offered through your employer's subscription.

4.2 Prohibited Conduct

You agree not to:

  • Share your account credentials with others
  • Access the platform using someone else's account
  • Use the platform for any fraudulent or illegal purpose
  • Attempt to circumvent any security measures
  • Scrape, copy, or redistribute content from the platform
  • Interfere with or disrupt the platform or servers
  • Use automated means to access the platform without permission
  • Resell or transfer offers or discounts to others
  • Use offers for business or commercial purposes unless explicitly permitted

5. Offers and Discounts

5.1 Third-Party Offers

PerkStation provides access to discounts and offers from third-party brands and retailers ("Partners"). We are not responsible for:

  • The availability, accuracy, or quality of any third-party offers
  • Changes to offer terms, prices, or availability
  • Your transactions with Partner brands
  • Any products or services purchased from Partners

5.2 Offer Terms

Each offer has its own terms and conditions set by the Partner. It is your responsibility to review and comply with these terms before redeeming any offer.

5.3 No Guarantee

We do not guarantee that any specific offers will be available at any time. Offers may be withdrawn, modified, or expire without notice.

6. Intellectual Property

The PerkStation platform, including all content, features, and functionality, is owned by PerkStation Ltd and protected by intellectual property laws. You may not copy, modify, distribute, sell, or lease any part of our platform without our written permission.

Partner brand logos, trademarks, and content displayed on our platform remain the property of their respective owners.

7. Disclaimer of Warranties

The platform is provided "as is" and "as available" without warranties of any kind, whether express or implied. We disclaim all warranties, including but not limited to:

  • Merchantability and fitness for a particular purpose
  • Accuracy, completeness, or reliability of content
  • Uninterrupted or error-free operation
  • Security of data transmission

8. Limitation of Liability

To the maximum extent permitted by law, PerkStation shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the platform, including but not limited to:

  • Loss of profits, data, or business opportunities
  • Any third-party conduct or content
  • Errors or omissions in offers or content
  • Unauthorised access to your account

Our total liability for any claim arising from these Terms shall not exceed the amount paid by your employer for your access to the platform in the 12 months preceding the claim.

9. Indemnification

You agree to indemnify and hold harmless PerkStation and its officers, directors, employees, and agents from any claims, damages, losses, or expenses arising from your breach of these Terms or your use of the platform.

10. Termination

We may suspend or terminate your access to the platform at any time, with or without cause, and with or without notice. Upon termination:

  • Your right to use the platform will immediately cease
  • Any pending offers or discounts will be forfeited
  • Provisions that by their nature should survive will remain in effect

11. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes by posting the updated Terms on our platform and updating the "Last updated" date. Your continued use of the platform after such changes constitutes acceptance of the new Terms.

12. Governing Law

These Terms shall be governed by and construed in accordance with the laws of England and Wales. Any disputes arising from these Terms shall be subject to the exclusive jurisdiction of the courts of England and Wales.

13. Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.

14. Entire Agreement

These Terms, together with our Privacy Policy and Cookie Policy, constitute the entire agreement between you and PerkStation regarding your use of the platform.
